FERC challenged for waiving construction rules for natural gas projects

Multiple public interest groups, landowners, and fishermen challenged the Federal Energy Regulatory Commission this week for waiving certain construction rules for natural gas projects.

The groups, led by the Southern Environmental Law Center, Natural Resources Defense Council, and the Sierra Club, filed a challenge on July 18 to FERC’s four orders in June that would speed up the development of natural gas pipelines and liquified natural gas export terminals.

FERC’s moves included a one-year waiver on an order that stalls construction while challenges to past FERC decisions are pending and a two-year waiver to increase the size and number of projects that qualify for blanket approvals.

The groups called FERC’s actions “highly irregular and unlawful” and argue that FERC cannot rely on the Trump Administration’s false claim of an “energy emergency” to waive its own rules.
