New York environmental regulators seek dismissal of Constitution Pipeline

The New York Department of Environmental Conservation is asking a federal regulator to dismiss an application to revive a controversial natural gas pipeline.

In a Feb. 20 filing, the agency said that a 2022 appeals court decision requires the Federal Energy Regulatory Commission (FERC) to dismiss a request to approve the 124-mile Constitution Pipeline that would move gas from Pennsylvania to markets in New York and New England.

Pipeline company Williams had long struggled to obtain necessary permits from New York regulators for the project and in 2020 suspended the project. Williams revived the project following the Trump Administration’s return to power, with the FERC saying last month it had received an application.

The New York Department of Environmental Conservation argued that FERC should dismiss the project now, “rather than requiring the Department and the other parties to engage in yet another round of wasteful administrative review over Constitution’s petition.”
