After four-year debate, Iowa passes bill restricting eminent domain for carbon pipelines

The Iowa Senate this week narrowly approved a bill that would make it more difficult to for companies to force landowners to accept carbon dioxide (CO2) pipelines.

The Senate voted 27-22 to send the bill to the governor’s office, following a four-year debate over landowner’s rights and carbon dioxide pipelines spurred by Summit Carbon Solution’s proposed pipeline crossing the state, Iowa Capital Dispatch reported.

Summit Carbon Solutions’ pipeline would transport CO2 from ethanol plants across Iowa, Minnesota, Nebraska, and the Dakotas to underground storage sites in North Dakota.

The pipeline ignited backlash from property owners concerned about lower property values and pipeline leaks on their land. The bill, first proposed by the Iowa House, would change which types of companies qualify for eminent domain, raise insurance requirements for pipeline companies, require reimbursement for landowners if their premiums go up due to the pipeline, and set new rules on public participation for the state’s utility commission.
